Dear Mr. President,


John Adams would charge into your office, slam this letter and his fist down on the desk in front of you, and question just how well you understand the Constitution. My name is Miles; I’m a Navy vet and I ask you the same question.

In a letter dated May 31, 2011, I wrote Assistant Attorney General Thomas Perry and informed him that Jones Day, Sonnenschein Nath & Rosenthal (now SNR Denton), Sherwin-Williams, and PDCA (Painting and Decorating Contractors of America) continue to orchestrate a campaign of threat, slander, false lawsuit, and discrimination against me in the attempt to deny my Constitutional freedom of free speech. I am sure Mr. Perry discussed the contents of my letter with your Attorney General, Mr. Holder.I have received no correspondence from either Mr. Perry or Mr. Holder, and can only assume that Mr. Perry and Mr. Holder disregard the importance of my letter and therefore refuse to take action. (Perhaps, because Mr. Holder was an attorney with Covington & Burling LLP, and Covington & Burling LLP has a close relationship with Jones Day, your Attorney General places favor and personal relationship above the law and the Constitution.)

My letter to Mr. Perry contains serious charges (including that Jones Day stopped two SEC investigations and then pressured the SEC to lie about those investigations) and gives names of the involved individuals. I presume, Mr. President, that as did our Founding Fathers, you fully recognize the content and importance of our Constitution. I presume also, Mr. President, your resolve to protect and defend our Constitutional freedoms and liberties.

I respectfully request that you question Mr. Holder regarding his failure to take the Constitution seriously. As a Constitutional lawyer, and more importantly, as President of the United States, I welcome your involvement in the defense of my, and all Americans’, Constitutional freedoms.

The following letter was sent to the Senate Ethics Committee

April 23, 2009

I formally request to bring Senator Lieberman and Senator Dodd before the Senate Ethics Committee. The charges are most serious and far reaching. Both Senators Lieberman and Dodd are guilty of defrauding a constituent (and all Americans) of representative government, of aiding and abetting the denial of a constituent’s (and all Americans) Constitutional freedoms, the violation and mocking of their Senatorial oaths, and the probable collusion in accepting campaign donations to distort and manipulate the law to undermine the Constitution and Bill of Rights.

In order for you to understand these charges, permit me to briefly summarize a continuum of actions and developments involving many participants. The paint company, Sherwin-Williams, stole a copyrighted product from me. When I complained, Sherwin-Williams and their legal firm, Jones Day, developed and mounted a campaign to silence my protests. Their attacks consisted of slander, libel, threat, filing of a false lawsuit, and a determined effort to deny me guaranteed Constitutional rights and freedoms. (I should add that Jones Day sometimes used and instructed subservient law firms, Howe, Anderson & Steyer and Day Pitney to carry out their attacks against me.) As one way to voice my complaints against Sherwin-Williams, I purchased company shares so that I would be able to attend the annual shareholders meetings and complain in person – which I did. I also attended the 2007 annual meeting. This annual meeting, quite surprisingly, was only lightly attended. After taking my seat in the almost empty auditorium, two Jones Day attorneys and two “muscle” companions proceeded to walk into my aisle and sit two on either side of me. Their intent was to intimidate me and prevent me from once again lodging complaints against Sherwin-Williams and the Board of Directors. These actions of Jones Day against me were sanctioned by Sherwin-Williams senior management, CEO Chris Connor and company attorney Louie Stilleto, and the entire Board of Directors, Richard Smuckers, A.Malachi Mixon 3rd, Robert Malloney, David Hodnik, Gary McCullough, Susan Kropf, Daniel Evans, James Boland, Arther Anton, and Curtis Thall. (For the record, I stayed the course and again spoke my protest and complaint.) I later filed two complaints with the SEC, one against Sherwin-Williams and one against Jones Day. After many months of delays and excuses, Sam Bezak of the SEC finally told me that the SEC investigations of both Sherwin-Williams and Jones Day were finished. Mr. Bezak also informed me that the content of those investigations were sealed and that I was prohibited from seeing copies of the investigations. I subsequently filed under the Freedom of Information Act to obtain copies of the two investigations. I was then informed by two different FOA officials that the SEC did not conduct any investigation of either Sherwin-Williams or of Jones Day. I then decided to contact my two Senators from Connecticut, Senator Dodd and Senator Lieberman, and ask them to investigate the SEC’s lies and fraudulent actions against me. At first, both Senators wrote the SEC asking the SEC for details and explanations. The SEC responded to the Senators evasively, admitted nothing, and said that they would take no further action. I told both Senators that the SEC reply to them was not acceptable, and I wanted them to again make inquiries. Senator Lieberman’s response (please see his enclosed letter and my reply to it) rebuffed me. Senator Dodd wrote the SEC a second time, again received a cold shoulder, and has distanced himself from any further action on my behalf. (It may be interesting to you that I’ve sent every Senator and every Representative both Senator Lieberman’s letter to me and, of course, my response to him. No one has responded to me.) It seems that Senators Lieberman and Dodd, as well as all the members of the Senate and House are not the least concerned that the SEC lies, commits fraud, and that Jones Day, the law firm representing Sherwin-Williams, has the connections and power to direct the SEC to stop their investigations of Sherwin-Williams and of Jones Day, direct the SEC to publicly lie about those investigations, or even that the SEC tells Senators and Representatives not to bother them and just look the other way.

As a matter of interest, and though not the first reason for summoning Senator Lieberman and Senator Dodd to come before you, Jones Day is one of the world’s most powerful legal firms. They have a vicious reputation of manipulating the law to their and their client’s advantage, and they are notorious for defrauding Americans of freedom and liberty. [You may be familiar with Jones Day actions against, for example, the “Swathmore Three” (sued because of publishing internal Diebold emails), or BlockShopper.] My particular fight with both Sherwin-Williams and Jones Day is ongoing. If anything, in all that I’ve said and written regarding the actions of Sherwin-Williams and, particularly, Jones Day against me were untrue, Jones Day would sue me and try every trick in the book to stop me. But Jones Day won’t come after me or sue me; Jones Day can’t sue the truth. Jones Day can’t sue the Constitution, they can’t sue the Bill of Rights; Jones Day can’t sue America.

Senator Lieberman and Senator Dodd are guilty of crimes against Americans; they have defrauded me, a Navy veteran, and indeed all Americans, the rights and privileges of fair, representative government. Their refusal to actively aid me in my complaints against the SEC, their acquiescence of bowing to SEC intimidation, and by extension, their silence and lack of action in opposing the agendas of Sherwin-Williams and Jones Day against me confess to their acceptance of undermining the Constitution and the denial of guaranteed individual freedoms. Senators Dodd and Lieberman are required to stand censored before the Senate Ethics Committee. It is public knowledge that Senator Lieberman and Senator Dodd have received and accepted campaign funding from both Sherwin-Williams and Jones Day: from Jones Day through the donations of individual attorney employees. I wonder if these contributions influence the decisions and behaviors of Senators Dodd and Lieberman.

It seems popular by those in power (and especially by those who are running for public office) to be in the spotlight when it comes to defending America and her Constitutional freedoms form threats and terrorist at tacks from abroad. It also seems, however, that when those same public officials are faced with defending Bill of Rights freedoms here in America from the actions of American companies and law firms, they scamper away in fear and cower in the shadows out of sight. I have to wonder, who really cares about the America envisioned by our Founding Fathers, the sacrifices of all those who fought and now fight to preserve that hope, or the fact that the core principles of American democracy and liberty are denied ordinary American citizens. Perhaps it is no longer, the hand that rocks the cradle rocks the world, but perhaps it is the hand of Jones Day that undermines America. I know, for example, that after resigning from Jones Day, William O’Reilly, was Chief Counsel for the House Ethics Committee (2006-2008), and after leaving that position, returned to Jones Day. Knowing how Jones Day operates, I have to reflect on all nuances of connections to power, connections to influence, and outcomes of mutual gain.

I petition the Senate Ethics Committee to call Senator Lieberman and Senator Dodd before it and question them thoroughly about their failure to take issue with the SEC falsifying and then lying about investigations, to question them about their disregard and contempt of the American Constitution and Bill of Rights (and their Senatorial oath), and to inquire of them if contributions from Sherwin-Williams and Jones Day influenced their behaviors. I trust that the Senate Ethics Committee hearings will be direct, honest, and uninfluenced except by the truths of fact.
